The Expired Domain Dele\u00adtion Pol\u00adi\u00adcy is an ICANN Con\u00adsen\u00adsus Pol\u00adi\u00adcy applic\u00ada\u00adble to all ICANN-Accred\u00adit\u00aded Reg\u00adis\u00adtrars. It has been incor\u00adpo\u00adrat\u00aded in the cur\u00adrent (21 May 2009) Reg\u00adis\u00adtrar Accred\u00adi\u00adta\u00adtion Agree\u00adment as fol\u00adlows:<\/p>\n
3.7.5 At the con\u00adclu\u00adsion of the reg\u00adis\u00adtra\u00adtion peri\u00adod, fail\u00adure by or on behalf of the Reg\u00adis\u00adtered Name Hold\u00ader to con\u00adsent that the reg\u00adis\u00adtra\u00adtion be renewed with\u00adin the time spec\u00adi\u00adfied in a sec\u00adond notice or reminder shall, in the absence of exten\u00adu\u00adat\u00ading cir\u00adcum\u00adstances, result in can\u00adcel\u00adla\u00adtion of the reg\u00adis\u00adtra\u00adtion by the end of the auto-renew grace peri\u00adod (although Reg\u00adis\u00adtrar may choose to can\u00adcel the name ear\u00adli\u00ader).<\/p>\n
3.7.5.1 Exten\u00adu\u00adat\u00ading cir\u00adcum\u00adstances are defined as: UDRP action, valid court order, fail\u00adure of a Registrar\u2019s renew\u00adal process (which does not include fail\u00adure of a reg\u00adis\u00adtrant to respond), the domain name is used by a name\u00adserv\u00ader that pro\u00advides DNS ser\u00advice to third-par\u00adties (addi\u00adtion\u00adal time may be required to migrate the records man\u00adaged by the name\u00adserv\u00ader), the reg\u00adis\u00adtrant is sub\u00adject to bank\u00adrupt\u00adcy pro\u00adceed\u00adings, pay\u00adment dis\u00adpute (where a reg\u00adis\u00adtrant claims to have paid for a renew\u00adal, or a dis\u00adcrep\u00adan\u00adcy in the amount paid), billing dis\u00adpute (where a reg\u00adis\u00adtrant dis\u00adputes the amount on a bill), domain name sub\u00adject to lit\u00adi\u00adga\u00adtion in a court of com\u00adpe\u00adtent juris\u00addic\u00adtion, or oth\u00ader cir\u00adcum\u00adstance as approved specif\u00adi\u00adcal\u00adly by ICANN.<\/p>\n
3.7.5.2 Where Reg\u00adis\u00adtrar choos\u00ades, under exten\u00adu\u00adat\u00ading cir\u00adcum\u00adstances, to renew a domain name with\u00adout the explic\u00adit con\u00adsent of the reg\u00adis\u00adtrant, the reg\u00adis\u00adtrar must main\u00adtain a record of the exten\u00adu\u00adat\u00ading cir\u00adcum\u00adstances asso\u00adci\u00adat\u00aded with renew\u00ading that spe\u00adcif\u00adic domain name for inspec\u00adtion by ICANN con\u00adsis\u00adtent with claus\u00ades 3.4.2 and 3.4.3 of this reg\u00adis\u00adtrar accred\u00adi\u00adta\u00adtion agree\u00adment.<\/p>\n
3.7.5.3 In the absence of exten\u00adu\u00adat\u00ading cir\u00adcum\u00adstances (as defined in Sec\u00adtion 3.7.5.1 above), a domain name must be delet\u00aded with\u00adin 45 days of either the reg\u00adis\u00adtrar or the reg\u00adis\u00adtrant ter\u00admi\u00adnat\u00ading a reg\u00adis\u00adtra\u00adtion agree\u00adment.<\/p>\n
3.7.5.4 Reg\u00adis\u00adtrar shall pro\u00advide notice to each new reg\u00adis\u00adtrant describ\u00ading the details of their dele\u00adtion and auto-renew\u00adal pol\u00adi\u00adcy includ\u00ading the expect\u00aded time at which a non-renewed domain name would be delet\u00aded rel\u00ada\u00adtive to the domains expi\u00adra\u00adtion date, or a date range not to exceed ten (10) days in length. If a reg\u00adis\u00adtrar makes any mate\u00adr\u00adi\u00adal changes to its dele\u00adtion pol\u00adi\u00adcy dur\u00ading the peri\u00adod of the reg\u00adis\u00adtra\u00adtion agree\u00adment, it must make at least the same effort to inform the reg\u00adis\u00adtrant of the changes as it would to inform the reg\u00adis\u00adtrant of oth\u00ader mate\u00adr\u00adi\u00adal changes to the reg\u00adis\u00adtra\u00adtion agree\u00adment (as defined in clause 3.7.7 of the reg\u00adis\u00adtrars accred\u00adi\u00adta\u00adtion agree\u00adment).\u201d<\/p>\n
3.7.5.5 If Reg\u00adis\u00adtrar oper\u00adates a web\u00adsite for domain name reg\u00adis\u00adtra\u00adtion or renew\u00adal, details of Registrar\u2019s dele\u00adtion and auto-renew\u00adal poli\u00adcies must be clear\u00adly dis\u00adplayed on the web\u00adsite.<\/p>\n
3.7.5.6 If Reg\u00adis\u00adtrar oper\u00adates a web\u00adsite for domain reg\u00adis\u00adtra\u00adtion or renew\u00adal, it should state, both at the time of reg\u00adis\u00adtra\u00adtion and in a clear place on its web\u00adsite, any fee charged for the recov\u00adery of a domain name dur\u00ading the Redemp\u00adtion Grace Peri\u00adod.<\/p>\n
3.7.5.7 In the event that a domain which is the sub\u00adject of a UDRP dis\u00adpute is delet\u00aded or expires dur\u00ading the course of the dis\u00adpute, the com\u00adplainant in the UDRP dis\u00adpute will have the option to renew or restore the name under the same com\u00admer\u00adcial terms as the reg\u00adis\u00adtrant. If the com\u00adplainant renews or restores the name, the name will be placed in Reg\u00adis\u00adtrar HOLD and Reg\u00adis\u00adtrar LOCK sta\u00adtus, the WHOIS con\u00adtact infor\u00adma\u00adtion for the reg\u00adis\u00adtrant will be removed, and the WHOIS entry will indi\u00adcate that the name is sub\u00adject to dis\u00adpute. If the com\u00adplaint is ter\u00admi\u00adnat\u00aded, or the UDRP dis\u00adpute finds against the com\u00adplainant, the name will be delet\u00aded with\u00adin 45 days. The reg\u00adis\u00adtrant retains the right under the exist\u00ading redemp\u00adtion grace peri\u00adod pro\u00advi\u00adsions to recov\u00ader the name at any time dur\u00ading the Redemp\u00adtion Grace Peri\u00adod, and retains the right to renew the name before it is delet\u00aded.<\/p>\n
