Purpose. This Uniform Domain Name Dispute Resolution Policy (the \u201cPolicy\u201d) has been adopt\u00aded by the Internet Corporation for Assigned Names and Numbers (\u201cICANN\u201d), is incor\u00adpo\u00adrat\u00aded by ref\u00ader\u00adence into your Registration Agreement, and sets forth the terms and con\u00addi\u00adtions in con\u00adnec\u00adtion with a dis\u00adpute between you and any par\u00adty oth\u00ader than us (the reg\u00adis\u00adtrar) over the reg\u00adis\u00adtra\u00adtion and use of an Internet domain name reg\u00adis\u00adtered by you. Proceedings under Paragraph 4 of this Policy will be con\u00adduct\u00aded accord\u00ading to the Rules for Uniform Domain Name Dispute Resolution Policy (the \u201cRules of Procedure\u201d), which are avail\u00adable at <a class=\"spip_url spip_out auto\" href=\"http:\/\/www.icann.org\/udrp\/udrp-rules-24oct99.htm\" rel=\"nofollow external\">www.icann.org\/udrp\/udrp-rules-24oct99.htm<\/a>, and the select\u00aded admin\u00adis\u00adtra\u00adtive-dis\u00adpute-res\u00ado\u00adlu\u00adtion ser\u00advice provider\u2019s sup\u00adple\u00admen\u00adtal rules.<\/p>\n<p>2. Your Representations. By apply\u00ading to reg\u00adis\u00adter a domain name, or by ask\u00ading us to main\u00adtain or renew a domain name reg\u00adis\u00adtra\u00adtion, you here\u00adby rep\u00adre\u00adsent and war\u00adrant to us that (a) the state\u00adments that you made in your Registration Agreement are com\u00adplete and accu\u00adrate; (b) to your knowl\u00adedge, the reg\u00adis\u00adtra\u00adtion of the domain name will not infringe upon or oth\u00ader\u00adwise vio\u00adlate the rights of any third par\u00adty; \u00a9 you are not reg\u00adis\u00adter\u00ading the domain name for an unlaw\u00adful pur\u00adpose; and (d) you will not know\u00ading\u00adly use the domain name in vio\u00adla\u00adtion of any applic\u00ada\u00adble laws or reg\u00adu\u00adla\u00adtions. It is your respon\u00adsi\u00adbil\u00adi\u00adty to deter\u00admine whether your domain name reg\u00adis\u00adtra\u00adtion infringes or vio\u00adlates some\u00adone else\u2019s rights.<\/p>\n<p>3. Cancellations, Transfers, and Changes. We will can\u00adcel, trans\u00adfer or oth\u00ader\u00adwise make changes to domain name reg\u00adis\u00adtra\u00adtions under the fol\u00adlow\u00ading cir\u00adcum\u00adstances:<\/p>\n<p>a. sub\u00adject to the pro\u00advi\u00adsions of Paragraph 8, our receipt of writ\u00adten or appro\u00adpri\u00adate elec\u00adtron\u00adic instruc\u00adtions from you or your autho\u00adrized agent to take such action;<\/p>\n<p>b. our receipt of an order from a court or arbi\u00adtral tri\u00adbunal, in each case of com\u00adpe\u00adtent juris\u00addic\u00adtion, requir\u00ading such action; and\/or<\/p>\n<p>c. our receipt of a deci\u00adsion of an Administrative Panel requir\u00ading such action in any admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading to which you were a par\u00adty and which was con\u00adduct\u00aded under this Policy or a lat\u00ader ver\u00adsion of this Policy adopt\u00aded by ICANN. (See Paragraph 4(i) and (k) below.)<\/p>\n<p>We may also can\u00adcel, trans\u00adfer or oth\u00ader\u00adwise make changes to a domain name reg\u00adis\u00adtra\u00adtion in accor\u00addance with the terms of your Registration Agreement or oth\u00ader legal require\u00adments.<\/p>\n<p>4. Mandatory Administrative Proceeding.<\/p>\n<p>This Paragraph sets forth the type of dis\u00adputes for which you are required to sub\u00admit to a manda\u00adto\u00adry admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading. These pro\u00adceed\u00adings will be con\u00adduct\u00aded before one of the admin\u00adis\u00adtra\u00adtive-dis\u00adpute-res\u00ado\u00adlu\u00adtion ser\u00advice providers list\u00aded at <a class=\"spip_url spip_out auto\" href=\"http:\/\/www.icann.org\/udrp\/approved-providers.htm\" rel=\"nofollow external\">www.icann.org\/udrp\/approved-providers.htm<\/a> (each, a \u201cProvider\u201d).<\/p>\n<p>a. Applicable Disputes. You are required to sub\u00admit to a manda\u00adto\u00adry admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading in the event that a third par\u00adty (a \u201ccom\u00adplainant\u201d) asserts to the applic\u00ada\u00adble Provider, in com\u00adpli\u00adance with the Rules of Procedure, that<\/p>\n<p>(i) your domain name is iden\u00adti\u00adcal or con\u00adfus\u00ading\u00adly sim\u00adi\u00adlar to a trade\u00admark or ser\u00advice mark in which the com\u00adplainant has rights; and<\/p>\n<p>(ii) you have no rights or legit\u00adi\u00admate inter\u00adests in respect of the domain name; and<\/p>\n<p>(iii) your domain name has been reg\u00adis\u00adtered and is being used in bad faith.<\/p>\n<p>In the admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading, the com\u00adplainant must prove that each of these three ele\u00adments are present.<\/p>\n<p>b. Evidence of Registration and Use in Bad Faith. For the pur\u00adpos\u00ades of Paragraph 4(a)(iii), the fol\u00adlow\u00ading cir\u00adcum\u00adstances, in par\u00adtic\u00adu\u00adlar but with\u00adout lim\u00adi\u00adta\u00adtion, if found by the Panel to be present, shall be evi\u00addence of the reg\u00adis\u00adtra\u00adtion and use of a domain name in bad faith:<\/p>\n<p>(i) cir\u00adcum\u00adstances indi\u00adcat\u00ading that you have reg\u00adis\u00adtered or you have acquired the domain name pri\u00admar\u00adi\u00adly for the pur\u00adpose of sell\u00ading, rent\u00ading, or oth\u00ader\u00adwise trans\u00adfer\u00adring the domain name reg\u00adis\u00adtra\u00adtion to the com\u00adplainant who is the own\u00ader of the trade\u00admark or ser\u00advice mark or to a com\u00adpeti\u00adtor of that com\u00adplainant, for valu\u00adable con\u00adsid\u00ader\u00ada\u00adtion in excess of your doc\u00adu\u00adment\u00aded out-of-pock\u00adet costs direct\u00adly relat\u00aded to the domain name; or<\/p>\n<p>(ii) you have reg\u00adis\u00adtered the domain name in order to pre\u00advent the own\u00ader of the trade\u00admark or ser\u00advice mark from reflect\u00ading the mark in a cor\u00adre\u00adspond\u00ading domain name, pro\u00advid\u00aded that you have engaged in a pat\u00adtern of such con\u00adduct; or<\/p>\n<p>(iii) you have reg\u00adis\u00adtered the domain name pri\u00admar\u00adi\u00adly for the pur\u00adpose of dis\u00adrupt\u00ading the busi\u00adness of a com\u00adpeti\u00adtor; or<\/p>\n<p>(iv) by using the domain name, you have inten\u00adtion\u00adal\u00adly attempt\u00aded to attract, for com\u00admer\u00adcial gain, Internet users to your web site or oth\u00ader on-line loca\u00adtion, by cre\u00adat\u00ading a like\u00adli\u00adhood of con\u00adfu\u00adsion with the complainant\u2019s mark as to the source, spon\u00adsor\u00adship, affil\u00adi\u00ada\u00adtion, or endorse\u00adment of your web site or loca\u00adtion or of a prod\u00aduct or ser\u00advice on your web site or loca\u00adtion.<\/p>\n<p>c. How to Demonstrate Your Rights to and Legitimate Interests in the Domain Name in Responding to a Complaint. When you receive a com\u00adplaint, you should refer to Paragraph 5 of the Rules of Procedure in deter\u00admin\u00ading how your response should be pre\u00adpared. Any of the fol\u00adlow\u00ading cir\u00adcum\u00adstances, in par\u00adtic\u00adu\u00adlar but with\u00adout lim\u00adi\u00adta\u00adtion, if found by the Panel to be proved based on its eval\u00adu\u00ada\u00adtion of all evi\u00addence pre\u00adsent\u00aded, shall demon\u00adstrate your rights or legit\u00adi\u00admate inter\u00adests to the domain name for pur\u00adpos\u00ades of Paragraph 4(a)(ii):<\/p>\n<p>(i) before any notice to you of the dis\u00adpute, your use of, or demon\u00adstra\u00adble prepa\u00adra\u00adtions to use, the domain name or a name cor\u00adre\u00adspond\u00ading to the domain name in con\u00adnec\u00adtion with a bona fide offer\u00ading of goods or ser\u00advices; or<\/p>\n<p>(ii) you (as an indi\u00advid\u00adual, busi\u00adness, or oth\u00ader orga\u00adni\u00adza\u00adtion) have been com\u00admon\u00adly known by the domain name, even if you have acquired no trade\u00admark or ser\u00advice mark rights; or<\/p>\n<p>(iii) you are mak\u00ading a legit\u00adi\u00admate non\u00adcom\u00admer\u00adcial or fair use of the domain name, with\u00adout intent for com\u00admer\u00adcial gain to mis\u00adlead\u00ading\u00adly divert con\u00adsumers or to tar\u00adnish the trade\u00admark or ser\u00advice mark at issue.<\/p>\n<p>d. Selection of Provider. The com\u00adplainant shall select the Provider from among those approved by ICANN by sub\u00admit\u00adting the com\u00adplaint to that Provider. The select\u00aded Provider will admin\u00adis\u00adter the pro\u00adceed\u00ading, except in cas\u00ades of con\u00adsol\u00adi\u00adda\u00adtion as described in Paragraph 4(f).<\/p>\n<p>e. Initiation of Proceeding and Process and Appointment of Administrative Panel. The Rules of Procedure state the process for ini\u00adti\u00adat\u00ading and con\u00adduct\u00ading a pro\u00adceed\u00ading and for appoint\u00ading the pan\u00adel that will decide the dis\u00adpute (the \u201cAdministrative Panel\u201d).<\/p>\n<p>f. Consolidation. In the event of mul\u00adti\u00adple dis\u00adputes between you and a com\u00adplainant, either you or the com\u00adplainant may peti\u00adtion to con\u00adsol\u00adi\u00addate the dis\u00adputes before a sin\u00adgle Administrative Panel. This peti\u00adtion shall be made to the first Administrative Panel appoint\u00aded to hear a pend\u00ading dis\u00adpute between the par\u00adties. This Administrative Panel may con\u00adsol\u00adi\u00addate before it any or all such dis\u00adputes in its sole dis\u00adcre\u00adtion, pro\u00advid\u00aded that the dis\u00adputes being con\u00adsol\u00adi\u00addat\u00aded are gov\u00aderned by this Policy or a lat\u00ader ver\u00adsion of this Policy adopt\u00aded by ICANN.<\/p>\n<p>g. Fees. All fees charged by a Provider in con\u00adnec\u00adtion with any dis\u00adpute before an Administrative Panel pur\u00adsuant to this Policy shall be paid by the com\u00adplainant, except in cas\u00ades where you elect to expand the Administrative Panel from one to three pan\u00adelists as pro\u00advid\u00aded in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split even\u00adly by you and the com\u00adplainant.<\/p>\n<p>h. Our Involvement in Administrative Proceedings. We do not, and will not, par\u00adtic\u00adi\u00adpate in the admin\u00adis\u00adtra\u00adtion or con\u00adduct of any pro\u00adceed\u00ading before an Administrative Panel. In addi\u00adtion, we will not be liable as a result of any deci\u00adsions ren\u00addered by the Administrative Panel.<\/p>\n<p>i. Remedies. The reme\u00addies avail\u00adable to a com\u00adplainant pur\u00adsuant to any pro\u00adceed\u00ading before an Administrative Panel shall be lim\u00adit\u00aded to requir\u00ading the can\u00adcel\u00adla\u00adtion of your domain name or the trans\u00adfer of your domain name reg\u00adis\u00adtra\u00adtion to the com\u00adplainant.<\/p>\n<p>j. Notification and Publication. The Provider shall noti\u00adfy us of any deci\u00adsion made by an Administrative Panel with respect to a domain name you have reg\u00adis\u00adtered with us. All deci\u00adsions under this Policy will be pub\u00adlished in full over the Internet, except when an Administrative Panel deter\u00admines in an excep\u00adtion\u00adal case to redact por\u00adtions of its deci\u00adsion.<\/p>\n<p>k. Availability of Court Proceedings. The manda\u00adto\u00adry admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading require\u00adments set forth in Paragraph 4 shall not pre\u00advent either you or the com\u00adplainant from sub\u00admit\u00adting the dis\u00adpute to a court of com\u00adpe\u00adtent juris\u00addic\u00adtion for inde\u00adpen\u00addent res\u00ado\u00adlu\u00adtion before such manda\u00adto\u00adry admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading is com\u00admenced or after such pro\u00adceed\u00ading is con\u00adclud\u00aded. If an Administrative Panel decides that your domain name reg\u00adis\u00adtra\u00adtion should be can\u00adceled or trans\u00adferred, we will wait ten (10) busi\u00adness days (as observed in the loca\u00adtion of our prin\u00adci\u00adpal office) after we are informed by the applic\u00ada\u00adble Provider of the Administrative Panel\u2019s deci\u00adsion before imple\u00adment\u00ading that deci\u00adsion. We will then imple\u00adment the deci\u00adsion unless we have received from you dur\u00ading that ten (10) busi\u00adness day peri\u00adod offi\u00adcial doc\u00adu\u00admen\u00adta\u00adtion (such as a copy of a com\u00adplaint, file-stamped by the clerk of the court) that you have com\u00admenced a law\u00adsuit against the com\u00adplainant in a juris\u00addic\u00adtion to which the com\u00adplainant has sub\u00admit\u00adted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In gen\u00ader\u00adal, that juris\u00addic\u00adtion is either the loca\u00adtion of our prin\u00adci\u00adpal office or of your address as shown in our Whois data\u00adbase. See Paragraphs 1 and 3(b)(xiii) of the Rules of Procedure for details.) If we receive such doc\u00adu\u00admen\u00adta\u00adtion with\u00adin the ten (10) busi\u00adness day peri\u00adod, we will not imple\u00adment the Administrative Panel\u2019s deci\u00adsion, and we will take no fur\u00adther action, until we receive (i) evi\u00addence sat\u00adis\u00adfac\u00adto\u00adry to us of a res\u00ado\u00adlu\u00adtion between the par\u00adties; (ii) evi\u00addence sat\u00adis\u00adfac\u00adto\u00adry to us that your law\u00adsuit has been dis\u00admissed or with\u00addrawn; or (iii) a copy of an order from such court dis\u00admiss\u00ading your law\u00adsuit or order\u00ading that you do not have the right to con\u00adtin\u00adue to use your domain name.<\/p>\n<p>5. All Other Disputes and Litigation. All oth\u00ader dis\u00adputes between you and any par\u00adty oth\u00ader than us regard\u00ading your domain name reg\u00adis\u00adtra\u00adtion that are not brought pur\u00adsuant to the manda\u00adto\u00adry admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading pro\u00advi\u00adsions of Paragraph 4 shall be resolved between you and such oth\u00ader par\u00adty through any court, arbi\u00adtra\u00adtion or oth\u00ader pro\u00adceed\u00ading that may be avail\u00adable.<\/p>\n<p>6. Our Involvement in Disputes. We will not par\u00adtic\u00adi\u00adpate in any way in any dis\u00adpute between you and any par\u00adty oth\u00ader than us regard\u00ading the reg\u00adis\u00adtra\u00adtion and use of your domain name. You shall not name us as a par\u00adty or oth\u00ader\u00adwise include us in any such pro\u00adceed\u00ading. In the event that we are named as a par\u00adty in any such pro\u00adceed\u00ading, we reserve the right to raise any and all defens\u00ades deemed appro\u00adpri\u00adate, and to take any oth\u00ader action nec\u00ades\u00adsary to defend our\u00adselves.<\/p>\n<p>7. Maintaining the Status Quo. We will not can\u00adcel, trans\u00adfer, acti\u00advate, deac\u00adti\u00advate, or oth\u00ader\u00adwise change the sta\u00adtus of any domain name reg\u00adis\u00adtra\u00adtion under this Policy except as pro\u00advid\u00aded in Paragraph 3 above.<\/p>\n<p>8. Transfers During a Dispute.<\/p>\n<p>a. Transfers of a Domain Name to a New Holder. You may not trans\u00adfer your domain name reg\u00adis\u00adtra\u00adtion to anoth\u00ader hold\u00ader (i) dur\u00ading a pend\u00ading admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading brought pur\u00adsuant to Paragraph 4 or for a peri\u00adod of fif\u00adteen (15) busi\u00adness days (as observed in the loca\u00adtion of our prin\u00adci\u00adpal place of busi\u00adness) after such pro\u00adceed\u00ading is con\u00adclud\u00aded; or (ii) dur\u00ading a pend\u00ading court pro\u00adceed\u00ading or arbi\u00adtra\u00adtion com\u00admenced regard\u00ading your domain name unless the par\u00adty to whom the domain name reg\u00adis\u00adtra\u00adtion is being trans\u00adferred agrees, in writ\u00ading, to be bound by the deci\u00adsion of the court or arbi\u00adtra\u00adtor. We reserve the right to can\u00adcel any trans\u00adfer of a domain name reg\u00adis\u00adtra\u00adtion to anoth\u00ader hold\u00ader that is made in vio\u00adla\u00adtion of this sub\u00adpara\u00adgraph.<\/p>\n<p>b. Changing Registrars. You may not trans\u00adfer your domain name reg\u00adis\u00adtra\u00adtion to anoth\u00ader reg\u00adis\u00adtrar dur\u00ading a pend\u00ading admin\u00adis\u00adtra\u00adtive pro\u00adceed\u00ading brought pur\u00adsuant to Paragraph 4 or for a peri\u00adod of fif\u00adteen (15) busi\u00adness days (as observed in the loca\u00adtion of our prin\u00adci\u00adpal place of busi\u00adness) after such pro\u00adceed\u00ading is con\u00adclud\u00aded. You may trans\u00adfer admin\u00adis\u00adtra\u00adtion of your domain name reg\u00adis\u00adtra\u00adtion to anoth\u00ader reg\u00adis\u00adtrar dur\u00ading a pend\u00ading court action or arbi\u00adtra\u00adtion, pro\u00advid\u00aded that the domain name you have reg\u00adis\u00adtered with us shall con\u00adtin\u00adue to be sub\u00adject to the pro\u00adceed\u00adings com\u00admenced against you in accor\u00addance with the terms of this Policy. In the event that you trans\u00adfer a domain name reg\u00adis\u00adtra\u00adtion to us dur\u00ading the pen\u00adden\u00adcy of a court action or arbi\u00adtra\u00adtion, such dis\u00adpute shall remain sub\u00adject to the domain name dis\u00adpute pol\u00adi\u00adcy of the reg\u00adis\u00adtrar from which the domain name reg\u00adis\u00adtra\u00adtion was trans\u00adferred.<\/p>\n<p>9. Policy Modifications. We reserve the right to mod\u00adi\u00adfy this Policy at any time with the per\u00admis\u00adsion of ICANN. We will post our revised Policy at at least thir\u00adty (30) cal\u00aden\u00addar days before it becomes effec\u00adtive. Unless this Policy has already been invoked by the sub\u00admis\u00adsion of a com\u00adplaint to a Provider, in which event the ver\u00adsion of the Policy in effect at the time it was invoked will apply to you until the dis\u00adpute is over, all such changes will be bind\u00ading upon you with respect to any domain name reg\u00adis\u00adtra\u00adtion dis\u00adpute, whether the dis\u00adpute arose before, on or after the effec\u00adtive date of our change. In the event that you object to a change in this Policy, your sole rem\u00ade\u00addy is to can\u00adcel your domain name reg\u00adis\u00adtra\u00adtion with us, pro\u00advid\u00aded that you will not be enti\u00adtled to a refund of any fees you paid to us.
